Attorney John B. Pike secured a full acquittal for a client charged with aggravated assault following a jury trial in Luzerne County involving a stabbing outside a Wilkes-Barre restaurant.

After a three-day trial, the jury deliberated for approximately 38 minutes before returning verdicts of not guilty on all charges.

## Incident Stemmed from Workplace Dispute

The charges arose from a confrontation outside a restaurant on Kidder Street in Wilkes-Barre in August 2022. According to testimony presented at trial, tensions between coworkers escalated over scheduling disputes and personal conflicts.

Evidence introduced during trial included cellphone video footage capturing the confrontation immediately before the physical altercation occurred.

The defense argued that the client was confronted and physically attacked by multiple individuals and acted reasonably in self-defense while attempting to protect himself from serious bodily harm.

Self-Defense Claim Presented to Jury

Attorney Pike emphasized during closing arguments that the evidence demonstrated the confrontation was initiated by others who had waited for the client outside the restaurant.

Trial testimony established that the client was physically assaulted, including being choked and struck repeatedly during the altercation.

“As he was being choked and assaulted, that was the deciding factor,” Pike argued to the jury. “His actions were reasonable to stop the assault.”

The defense further highlighted that the client immediately called 911 after the incident and cooperated with responding officers.

Jury Returns Not Guilty Verdicts

The prosecution argued the injuries sustained during the altercation were severe and warranted felony convictions. The defense maintained the evidence supported lawful self-defense under Pennsylvania law.

Following brief deliberations, the jury acquitted the client of all charges.
